TERMS AND CONDITIONS

1. Identity and Nature of Service

Cozumel Private Tours (hereinafter referred to as “the Platform”) acts solely as a commercial intermediary between the end customer and independent third-party tour service providers. The Platform is not the direct operator of the services offered (tours, transportation, vessels, experiences, etc.), and therefore, the execution of such services is the sole responsibility of the corresponding provider.

2. Acceptance of Terms

By making a reservation, the customer expressly agrees to these Terms and Conditions, as well as the cancellation, rescheduling, liability, and privacy policies described herein.

3. Reservation and Payment Process

Reservations may be made through full or partial payment (deposit). Accepted payment methods: digital platforms (Stripe, PayPal, etc.), bank transfer, or cash (when applicable, typically for remaining balances). A reservation is considered confirmed only once the payment has been received. Customers accept any additional processing fees when using digital payment platforms.

4. Relationship with Providers

Services are provided by independent third parties, who are solely responsible for tour operation, safety, equipment/vessel condition, and local regulation compliance. Cozumel Private Tours selects providers based on quality standards but does not control direct operations.

5. Customer Responsibility

Customers agree to provide accurate information when booking, comply with schedules, follow operator instructions, and inform any relevant medical conditions.

6. Limitation of Liability

Cozumel Private Tours shall not be held liable for accidents, injuries, or incidents during the service, loss of belongings, provider operational changes, or failures attributable to the provider. This applies especially to activities involving inherent risk such as marine tours, water activities, or land transportation.

7. Special Conditions for Marine Activities

All marine activities are subject to authorization by the Cozumel Port Authorities. In case of restrictions, the service may be rescheduled or canceled in accordance with established policies.

8. Force Majeure

In the event of circumstances beyond control (weather, government restrictions, health situations), the service may be modified, rescheduled, or canceled.

9. Governing Law

These Terms are governed in accordance with the Federal Consumer Protection Law (Mexico) and applicable tourism regulations.


CANCELLATION AND RESCHEDULING POLICIES

1. Customer Cancellations

Cancellations made more than 48 hours in advance: Eligible for refund, subject to deductions. Within 48 hours: Non-refundable under any circumstances.

2. No Show

If the customer does not show up for the scheduled service, it will be considered a No Show and no refund will be issued.

3. Rescheduling

Requests must be made more than 48 hours prior to the service, subject to provider availability and through official communication channels with full reservation details.

4. Provider or Weather Cancellations

If the service cannot be carried out due to weather, safety, or port restrictions, customers will be offered free rescheduling or a refund (subject to deductions).

5. Refunds

In the event of a refund, processing fees and a 7% administrative fee for taxes/operations will be deducted. Refunds will be processed no earlier than 15 business days after all info is submitted. Full refunds are not issued due to platform fees and admin costs.


LIABILITY AND SAFETY POLICIES

1. Inherent Risk

Customers acknowledge physical risks and participate at their own responsibility. They must inform providers of any medical conditions or limitations.

2. Liability Disclaimer

By booking, customers acknowledge that Cozumel Private Tours acts solely as an intermediary and is not directly responsible for incidents arising from third-party services.

3. Customer Conduct

Providers reserve the right to deny service without refund if the customer is under the influence of substances, displays inappropriate behavior, or poses a risk.

4. Insurance

Customers are strongly advised to have travel insurance and medical coverage.
